The firm’s attorneys have appeared before over 40 state public utilities commissions, shaping policy on a wide range of issues including distributed energy resources (DER) and DER aggregation, energy efficiency, demand response, community choice aggregation, transportation electrification, community solar programs, net metering policy, data access, green tariffs, integrated resource plans, microgrids, interconnection standards, grid modernization, and fair competition in energy markets. K&F has deep expertise in utility rate making and rate design, utility mergers and restructuring, energy program cost-effectiveness assessments, and integrated resource planning.

K&F attorneys also regularly represent clients before the Federal Energy Regulatory Commission on matters involving Open Access Transmission Tariff and RTO/ISO tariff compliance and disputes, DER interconnection and participation in wholesale markets, and the expansion of wholesale markets.

Regulatory Compliance

K&F attorneys leverage their deep expertise in the energy regulatory space to advise clients on their regulatory compliance obligations and help clients navigate complex and novel regulatory compliance and incentive eligibility questions. Our team counsels developers, original equipment manufacturers, local government entities and power providers, and investors on nuanced regulatory compliance questions arising across all stages of project and business plan development.

For example, the firm regularly assists CCA clients with procurement compliance obligations, including integrated resource plans, renewable portfolio standard requirements, and resource adequacy. The firm also advises CCAs and local government entities such as Regional Energy Networks on load management standards, energy efficiency incentive programs, and other regulatory requirements.

In addition to this work with local governments, K&F attorneys also regularly advise clean energy industry clients on the dynamic regulatory landscape impacting their business development and strategy.
